A man who recorded himself sexually assaulting a woman as she slept, and who formerly served as a Police Scotland officer, has received a seven-year prison sentence after admitting a range of violent and sexual offences involving two women.

Derek McNee, 43, was sentenced at the High Court in Glasgow on 2 November 2026.

Judge David Young KC told McNee: "There can be no free agreement when someone is incapable to give consent."

The judge also ordered McNee to be monitored for 18 months after his release.

McNee repeatedly attacked his victim at a house in Milngavie, East Dunbartonshire in 2025.

Police discovered four incriminating videos on his mobile phone that he had recorded himself, according to the Scotland Police report.

Before the attacks, McNee manipulated the woman by asking whether it would "arouse" her if he "did things" while she slept.

She agreed.

He then suggested filming the acts, and the woman — who had personal issues — said "he could if he wanted to."

McNee later sent her the footage he had recorded.

She looked at the clips but told him to delete them.

Judge Young noted that in two victim impact statements the woman described her "misery" at McNee's hands and said she remains affected.

McNee's offending spanned violent and sexual attacks against two women across the Glasgow and East Dunbartonshire areas between 2021 and 2025.

He was described in court as heavily tattooed.

He pleaded guilty on 2 September 2026 and was placed on the sex offenders register indefinitely, with a non-harassment order made against him in respect of both women.

McNee had previously served as a Police Scotland officer before resigning from the force in 2016.

Detective Inspector Mairi MacDonald praised both victims for their bravery, according to the Scotland Police report.

"Derek McNee subjected these women to horrific abuse, and I would like to commend their courage in coming forward and speaking to us," she said.

"They played an instrumental role in bringing this despicable individual to justice and I hope this outcome provides them with some closure and comfort."

DI MacDonald also issued a wider appeal to other victims.

"Police Scotland does not tolerate violence or sexual abuse in any form, and I hope this outcome gives other victims the confidence to come forward and make a report to us," she said.

"We are here to listen and to help, and our specially trained officers will support you throughout the process, alongside our partner agencies."
