Appeals court including two Trump appointees doubts DOJ bid to set aside 20,000 California ballots it says went to noncitizens

Los Angeles' top federal prosecutor Bill Essayli warned the November 3 midterms will be 'corrupted', saying California has confirmed it will count the contested votes. Los Angeles County alone has already processed 331,000 mail ballots. Judge Gabriel Sanchez said DOJ lawyer Matthew Donnelly could not explain who the third parties behind the list were. The panel adjourned on Sunday without a ruling.

Donnelly said the voter list was 'purchased' from the state by an unnamed third party.

US District Judge David Carter is due to hold his own hearing on Tuesday.

Essayli vowed to fight on: 'Even one noncitizen vote is one too many.'
