California election officials who count ballots of suspected noncitizens face prosecution, Trump's Justice Department warns

First Assistant US Attorney Bill Essayli warned that 'knowingly processing noncitizen ballots is a federal crime' and vowed to hold officials accountable. Letters to every California county gave registrars 48 hours to say who on a federal list is a citizen. Mail-in ballots of anyone unconfirmed must be set aside, not cancelled. The midterms are on November 3.

The Ninth Circuit ordered California to answer the emergency request over 20,000 ballots by noon Saturday.

Contra Costa clerk Kristin B. Connelly hit back: 'Voters need to vote and not be intimidated.'

Essayli was blunt: 'California does not verify citizenship status. We did the work for them.'
