Olivier Martinez was granted a temporary restraining order and primary custody of 12-year-old Maceo on Thursday after alleging in Los Angeles court papers that Halle Berry "jumped on him, putting her hands around his neck and choking him" while shouting "Who is dominant now?" Berry's lawyer Marina Beck called the claims "entirely meritless and deliberately misleading," while Berry is reportedly "really saddened" by what has emerged.

Berry is now limited to seeing Maceo on Mondays, Tuesdays and alternate weekends, pending an October 16 hearing.

Court documents allege Martinez also cited "additional physical attacks" and verbal abuse "over the course of the last few years" — not just the single incident.

The pair had already tried six joint co-parenting therapy sessions, which broke down; Berry's lawyer fired back that Martinez has "a well-documented history of erratic, possessive and violent behavior."
