A Los Angeles judge ruled Thursday that Olivier Martinez will hold primary physical custody of his and Halle Berry's 13-year-old son Maceo, ending the previous 50-50 split. Berry's attorney Marina Beck called it a partial victory after the judge dissolved Martinez's domestic violence restraining order, which had threatened to bar Berry from seeing Maceo entirely. The modified custody arrangement stays in place until November, when both parties return to court.

Martinez had accused Berry of choking Maceo during a 26 September incident — allegations Berry flatly denies.

Berry's 18-year-old daughter Nahla Aubry, from a separate relationship, took the stand earlier this week to testify on her mother's behalf.

The judge also rejected Martinez's bid to restrict Berry's time with Maceo over the holidays, one of several demands he failed to secure.
