Nahla Aubry, Halle Berry's 18-year-old daughter, has filed a sworn declaration with Los Angeles Superior Court attesting that she has never witnessed her mother act violently toward anyone. The declaration comes after Berry's ex-husband Olivier Martinez, 60, obtained a temporary domestic violence restraining order against Berry on 1 October, alleging she choked their 13-year-old son Maceo during an incident on 26 September.

Nahla wrote: 'I have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way.'

Martinez is also seeking an emergency modification to the existing 50-50 custody arrangement and a no-contact order before a court hearing on 16 October.

Nahla additionally alleged that she witnessed Martinez assault her father, Gabriel Aubry, when she was a child.
