At the centre of the case is a second Republican on the ballot, Daniel J. Sullivan Jr, whom the Justice Department accuses of running to mislead backers of Senator Dan Sullivan. The suit was filed in federal court in Anchorage. Democrat Mary Peltola is neck and neck with the incumbent before the 3 November midterms. Alaska's state courts ruled earlier this year that Sullivan Jr could stay on the ballot.
Attorney General Todd Blanche refused a day earlier to rule out future certification interventions.
The DOJ wants an investigation into whether Sullivan Jr's votes were meant for the senator.
