Judge says 'sorry' as England striker Ivan Toney's nightclub assault trial is set for 2028 due to 'massive backlog'

England striker Ivan Toney, 30, appeared at Southwark Crown Court on Thursday and pleaded not guilty to assaulting Saber Da Silva at the 100 Wardour Street club in Soho on 6 December 2025. Judge Christopher Hehir apologised to Toney over the crown court backlog and scheduled a provisional trial for 12 June 2028. The five-minute hearing concluded with Toney leaving on unconditional bail.
Toney is alleged to have lunged at Da Silva, headbutted him, and then thrown several punches during a confrontation at the venue.
The 2028 trial date falls three days into the European Championships, hosted in the UK and Ireland, potentially ruling Toney out of the tournament.
Toney was part of the England squad at this summer's World Cup but has not been selected for the most recent Nations League squad.
