The White House has confirmed it will appeal after Trump-appointed District Judge Timothy Kelly extended a preliminary injunction forcing the restoration of access for CNN, MSNOW and Politico reporters, ruling that Trump likely violated the First Amendment by banning the outlets over their coverage. The Department of Justice appealed within 24 hours, launching a legal battle expected to grind through courts for months. Kelly found Trump's own public statements proved the ban was driven by dislike of the reporting, not national security as the administration later claimed.

Kelly, whom Trump himself appointed in 2017, wrote the ban amounted to 'unlawful viewpoint discrimination' against the outlets.
