An 11-year-old girl has been charged with aggravated battery — a felony — after footage from Nautilus Middle School's cafeteria in Miami Beach showed her beating a classmate in what police described as a sustained attack. The victim's mother has filed a lawsuit against Miami-Dade County Public Schools, alleging staff failed to protect her daughter. The suspect's mother, meanwhile, told reporters her daughter had been bullied and insisted she is the real victim.

The victim's mother called the assault "a beat down," saying her daughter was left with lasting injuries.

The suspect's mother argues her child was provoked and says charging an 11-year-old with a felony goes too far.

The lawsuit against M-DCPS alleges the school failed to act on prior bullying complaints before the filmed attack.
