One of the 'Cornell 7' asks a judge to throw out claims his lawyer calls 'a lawsuit about a forced kiss'

Diego Sarabia, a former Cornell student, filed a motion on Friday seeking dismissal from Jane Doe's civil lawsuit and denies every allegation. His lawyer, James C Knox, argues the claims are legally insufficient, too late, or both. Knox says Doe never alleged Sarabia supplied drugs or alcohol or joined the alleged sexual encounters. He claims a one-year limit has already expired.
In Doe's account, Sarabia seized her by the face, kissed her and snorted ketamine off her body.
The alleged attack took place at the now-defunct Chi Phi fraternity house in Ithaca in October 2024.
Sarabia has reportedly been fired by Wells Fargo in Charlotte, North Carolina.
