Mondelēz International filed papers at London's High Court this month accusing Catherine's Originals of "passing off" and trademark infringement over its O'bar, a segmented chocolate bar with rounded semi-oval humps.

Dodd insists the bar's distinctive shape reflects the 'O' in Originals, not Toblerone's famous triangular mountain peaks.

Mondelēz spent several months attempting to settle the dispute directly with Catherine's Originals before resorting to High Court action.

Catherine's Originals' legal adviser Stephen Lowry, of Brandsmiths, says the O'bar has "its own distinctive design and identity."
