Trump's DOJ plans to appeal after a judge throws out its bid to block Alaska's Senate result over 'Decoy Dan'
U.S. District Judge Sharon Gleason in Anchorage ruled the Justice Department lacked legal standing and offered "no workable plan" to investigate ballots without violating voter secrecy. The DOJ filed the suit less than two weeks before Tuesday's midterm elections, while early voting was already under way, demanding Alaska segregate ballots cast for retired teacher Daniel J. Sullivan from those intended for Republican incumbent Senator Dan Sullivan.
Judge Gleason wrote that the administration's proposed ballot segregation would breach Alaskans' constitutional right to a secret vote.
Democrat Mary Peltola, the incumbent senator's rival, has denied any involvement in recruiting the second Dan Sullivan, calling herself 'not interested in tricking voters.'
The second Sullivan, a retired teacher from a remote fishing village, has said he would prefer Peltola win over the Republican senator.
