US appeals court resists Trump bid to segregate 20,000 California ballots the DOJ says went to likely noncitizens

'I don't see how we have jurisdiction,' Judge Mark Bennett told Justice Department lawyers at a rare Sunday hearing of the 9th Circuit. Judge Gabriel Sanchez questioned whether the administration's list of suspect voters could be trusted at all. The DOJ wants the ballots set aside and checked before counting. A trial judge is not due to hear the case until Tuesday.
Court filings reveal that mail ballots processed in Los Angeles County alone have already reached 331,000.
DOJ attorney Matthew Donnelly said the list was bought from California and handed to officials.
Sanchez said the lawyers 'were not able to explain' the third parties behind the list.
