US judge throws out ex-husband's restraining order against Halle Berry over abuse claims while keeping his custody arrangement until November
Los Angeles Superior Court Judge Shelley Kaufman declined to make permanent the temporary domestic violence restraining order Olivier Martinez had sought, delivering her ruling after the couple's 13-year-old son, Maceo, spent close to four hours giving sealed testimony across nine days of proceedings overall. Berry's attorney Marina Beck called it "a huge win for Halle," but Martinez retains the modified custody arrangement — including restricted overnight visits — until a further court hearing in November.
Martinez, 60, had accused Berry of choking Maceo during a September 26 altercation and sought sole physical and legal custody, replacing their previous 50-50 arrangement.
Berry's 18-year-old daughter, Nahla Aubry, testified in her mother's defence, saying she was "shocked" by the abuse allegations and had never witnessed Berry behave aggressively toward her half-brother.
Martinez stormed out of the courtroom and used profanity during proceedings, while Berry denied all abuse claims, stating: 'I am a victim of domestic violence — I would never hurt our child.'
