US judge throws out Trump administration's lawsuit to block Alaska Senate certification over the 'other' Dan Sullivan on the ballot
U.S. District Judge Sharon Gleason ruled the DOJ's requested relief was "infeasible" because ballots are already cast, dismissing the administration's bid to delay or block certification of Alaska's Senate race. Trump had personally ordered the Justice Department to file the suit, a move experts called an "unprecedented intervention" in a midterm election. The case centred on a second candidate named Dan Sullivan appearing on the ballot, which the DOJ claimed risked voter confusion and could hand Democrats the seat held by Republican incumbent Dan Sullivan.
The DOJ says it plans to appeal Judge Gleason's ruling, keeping the fight over Alaska's certification alive.
The dismissal came as the Trump administration was reportedly trying to stave off a GOP defeat — the lawsuit was explicitly designed to protect the Republican incumbent's seat.
Judge Gleason found the administration had failed to show how she could remedy their concerns, given the ballots had already been cast.
