US judge tosses case against two ex-FBI officials accused of lying to Congress about the Hunter Biden laptop probe

Judge Zia Faruqui dismissed charges against former FBI officials Nikki Floris and Bradley Benavides from the bench on Monday, declaring the prosecution "cannot be described as anything other than weaponization" of the Justice Department. He branded the case a "rush job" directed by Trump and FBI Director Kash Patel, and scolded federal prosecutors for bringing it.

Faruqui ruled that the false-statements charges lacked probable cause, dealing a significant blow to Trump's DOJ.

The dismissal does not foreclose prosecutors from pursuing a grand jury indictment on the same matter.
