NewsHound respects the intellectual property rights of content creators and news publishers. This page describes our approach to copyright, how to file a takedown notice under the Digital Millennium Copyright Act (DMCA), and our counter-notification procedure.

1. How NewsHound Uses Publisher Content

NewsHound is a news aggregation service. We do not reproduce full articles. Our use of publisher content is limited to:

We believe this use constitutes fair use under 17 USC 107. We do not reproduce, store, or display the full text of any article. Our service drives traffic to original publishers by linking readers directly to their sites.

2. Filing a DMCA Takedown Notice

If you believe that content on NewsHound infringes your copyright, you may submit a DMCA takedown notice. Under 17 USC 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it (e.g., the URL where the material appears on NewsHound).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receiving a valid DMCA notice, we will promptly remove or disable access to the material identified in the notice and notify the party responsible for the content, if applicable.

3. Counter-Notification

If you believe that material was removed or disabled as a result of mistake or misidentification, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which NewsHound may be found), and that you will accept service of process from the person who submitted the original takedown notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.

4. Repeat Infringer Policy

In accordance with the DMCA, NewsHound maintains a policy of terminating access for users or content sources that are repeat infringers in appropriate circumstances. If a publisher or content source is the subject of multiple valid DMCA notices, we may permanently remove that source from our aggregation service.

5. Good Faith and Fair Use

Before filing a DMCA notice, please consider whether the use of the material constitutes fair use. Under 17 USC 107, fair use factors include the purpose of the use, the nature of the copyrighted work, the amount used, and the effect on the market for the original work. NewsHound's use of short summaries and thumbnail previews, with direct links to original articles, is designed to complement -- not replace -- the original publisher's content.

Misrepresentation in a DMCA notice or counter-notification may result in liability for damages under 17 USC 512(f).

6. Publisher Opt-Out

If you are a publisher and would prefer that your content not appear on NewsHound, you do not need to file a DMCA notice. Simply contact us at contactus@thenewshound.com and we will remove your publication from our aggregation sources.
